MINUTES OF THE
CITY OF SAN RAMON – COUNCIL MEETING
September 4, 2009

A special meeting of the City Council of the City of San Ramon was held September 4, 2009 at 5:31 p.m. in the City Council Chamber at City Hall, 2222 Camino Ramon, Mayor Wilson presiding. 
PRESENT:  Councilmembers Livingstone, Perkins, Rowley, Vice Mayor Hudson, and Mayor Wilson.
STAFF PRESENT:  City Manager Herb Moniz, Interim City Attorney Roger Peters, and Deputy City Clerk Renee Beck.

UNFINISHED BUSINESS

(#9.1) Public Hearing:  Ordinance No. XXX (next in line) – Introducing an Urgency Ordinance of the City of San Ramon Establishing a 45 Day Moratorium on the Issuance of Any New, or Expansion of Any Existing, Massage Establishment or Massage Therapist Permits.

Interim City Attorney Roger Peters provided the report.  He stated that the proposed urgency ordinance prohibits new individual massage licenses, licensing of massage businesses, or expansion of existing massage businesses.  He indicated that renewals of current individual and business massage licenses and those already in the exempt category shall be exempt from this moratorium.  This urgency ordinance will be in effect for 45 days and may be renewed for a total of 2 years.  He noted that there may be one extension.  The urgency ordinance provides time for staff to assess the implementation of new State law regarding massage licensing. 

Vice Mayor Hudson’s motion to introduced the urgency ordinance and waive the reading was seconded by Cm. Livingstone and passed 5-0.

Mayor Wilson opened the public hearing.

Andrea Willoughby, resident and business owner, asked how long the urgency ordinance might be extended.  Mayor Wilson responded that it will depend on how long it takes to get clarification from the State.  Ms. Willoughby also asked if she would be able to relocate her business within the City.  Mayor Wilson responded that she would.

Mayor Wilson closed the public hearing.

Vice Mayor Hudson’s motion to adopt the urgency ordinance was seconded by Cm. Livingstone and passed 5-0.

Coucilmember Perkins extended good luck to the Cal High Grizzlies in the first game of the season.

Cm. Livingstone thanked Mayor Wilson, City Manager Herb Moniz, and City staff for an exceptional Mayor’s Conference hosted by the City of San Ramon.

At 5:47 p.m., there being no further business, Mayor Wilson adjourned the meeting.
