MINUTES OF THE
CITY OF SAN RAMON – COUNCIL MEETING

September 8, 2009

A regular meeting of the City Council of the City of San Ramon was held September 8, 2009 at 7:08 p.m. in the City Council Chamber at City Hall, 2222 Camino Ramon, Mayor Wilson presiding. 
PRESENT:  Councilmembers Hudson, Livingstone, Perkins, and Mayor Wilson.
ABSENT:  Councilmember Rowley.
STAFF PRESENT:  Central Services Division Manager Pat Perry and City Clerk Patricia Edwards.

PLEDGE OF ALLEGIANCE

Former San Ramon City Mayors Patricia Boom, Curt Kinney, Mary Lou Oliver, and Diane Schinnerer led those in attendance in the pledge of allegiance.

APPROVAL OF MINUTES

Vice Mayor Hudson noted that there was a lack of voting quorum.  Mayor Wilson continued approval of the August 25, 2009 City Council meeting minutes to the September 22, 2009 Council meeting.

CONSENT CALENDAR

(#8.1) Resolution No. 2009-143 – Accepting Certain Landscape Improvements at the Dougherty Valley Service Center for Maintenance (Shapell Industries).

(#8.2) Resolution No. 2009-144 – Authorizing the Mayor to Execute Amendment No. 2 to the Existing Agreement with T. Marshall Associates, Ltd. to Renew the Agreement for Electrical Services in a Total Annual Amount Not To Exceed $50,000.

Vice Mayor Hudson’s motion to approve items 8.1 and 8.2 was seconded by Cm. Livingstone and passed 4-0.  Cm. Rowley was absent.

NEW BUSINESS

(#10.1) Resolution 2009-145 – Proclaiming Byron D. Athan as City Attorney Emeritus.

City Manager Herb Moniz provided the report.  Byron D. Athan has served the San Ramon community and the City tirelessly for more than 25 years.  His service included serving on the committee that led to the City’s incorporation.  His contributions have been made as a volunteer, a civil servant, and as an elected official.  He served the City in the capacities of City Manager, Councilmember, Mayor, and City Attorney.  In appreciation for Mr. Athan’s lifetime of service to his family, community, and country, Mr. Moniz requested that the Council appoint Mr. Athan as the City Attorney Emeritus.

Former Mayor Diane Schinnerer enumerated Mr. Athan’s accomplishments and service to San Ramon.  She stated that he is known and respected for his honesty, integrity, work ethic, and knowledge of the law.  Athan Downs Park is named for Mr. Athan in honor of his successful lobbying for parkland dedication funds from developers in 1970.

Deputy City Attorney Alicia Poon shared her thoughts on what Mr. Athan has meant to her as a mentor, a teacher, a colleague and a friend.

Vice Mayor Hudson thanked Mr. Athan for his advice and stated that one could not learn from a better person.  Cm. Livingstone stated that Mr. Athan is an expert on the Brown Act and expressed his appreciation for his friendship and professional counsel.  Cm. Perkins added that Mr. Athan has given the City the greatest gifts of his time and his experience.  He always had the City’s best interest in his heart and in his actions. 

Mayor Wilson noted that Cm. Rowley sent her regrets at being unable to attend the meeting and wished Mr. Athan well.

Cm. Perkins’ motion to adopt Resolution No. 2009-145 was seconded by Cm. Livingstone and passed 4-0.  Cm. Rowley was absent.

Mayor Wilson read the Resolution and presented Mr. Athan with a framed copy which was signed by each Councilmember.  He stated that Mr. Athan has been a valued friend and mentor.  He thanked Mr. Athan for his service to the City and contributions to the San Ramon family and community.  Dr. Karen Wilson presented a rose bouquet to Mrs. Athan and thanked her for sharing Mr. Athan’s intellect and his time with San Ramon.

San Ramon Poet Laureate Patricia Perry read a poem which she wrote for the occasion.  Mr. Athan thanked everyone for their thoughts and well wishes and expressed his sadness at leaving the City.

At 7:48 p.m., there being no further business, Mayor Wilson adjourned the meeting in honor of Byron D. Athan, City Attorney Emeritus, friend, colleague, and mentor.
