June 8, 2010
A special joint meeting of the City Council and the Redevelopment Agency of the City of San Ramon was held June 8, 2010 at 6:39 p.m. in the City Council Chamber at City Hall, 2222 Camino Ramon, Mayor Wilson and Agency Chair Rowley presiding.

JOINT PUBLIC HEARING
(#3.1) Joint Public Hearing of the City Council of the City of San Ramon and the Redevelopment Agency of the City of San Ramon on the Expenditure of $3,000,000 by the Redevelopment Agency for the Acquisition of Land Located Adjacent to 6100 Camino Tassajara (APN: 223-020-018) and Construction of a Fire Training Facility by the San Ramon Valley Fire Protection District.
Resolution RDA 2010-005 – Authorizing the Expenditure of $3,000,000 by the Redevelopment Agency of the City of San Ramon for the Acquisition of Land (APN: 223-020-018) and Construction of a Fire Training Facility by the San Ramon Valley Fire Protection District.
Resolution No. 2010-070 –Authorizing the Expenditure of $3,000,000 by the Redevelopment Agency of the City of San Ramon for the Acquisition of Land (APN: 223-020-018) and Construction of a Fire Training Facility by the San Ramon Valley Fire Protection District.
Mayor Wilson opened the joint public hearing of the City Council and the Redevelopment Agency Board. Mayor Wilson reviewed the procedure which included: staff presentation, receipt of written comments, receipt of oral testimony, and consideration and action on the proposed resolutions.
Deputy Executive Director Marc Fontes entered into the record of the public hearing two documents: Proof of Publication of the Notice of the Public Hearing and The Summary Report required by Health and Safety Code Section 33679. The City Clerk acknowledged receipt of both documents.
Deputy Executive Director Fontes provided the staff report. In 2007, the City and the San Ramon Valley Fire Protection District (District) entered into an agreement which obligates the City to pay to the District $1 million in each of 2010, 2011 and 2012 for the acquisition of property for use as a fire training facility. Use of Agency funding for the fire training facility was included in the Agency’s adopted 2010-2014 Implementation Plan. The City’s General Plan calls for mixed use development in the Crow Canyon Specific Plan (CCSP) portion of the Redevelopment Project Area and the City Center Project area. This mixed-use development within the City will be some of the denser and taller buildings within the District’s boundaries. In order for the District to be properly prepared to respond to emergency situations, the District has identified the need for a new training center. The CCSP is primarily causing the need for the facility and the primary benefit is to the Redevelopment Project area. The Project is consistent with the Implementation Plan and the Redevelopment Plan objectives. The Project will be entitled and carried forward by the District. The City’s only involvement is to be a partial source of funding for the Project using a portion of the Redevelopment Agency’s available bond funding.
Cm. Livingstone emphasized that the City does not own the property. He clarified that the City is providing $3 million per the District Agreement. The City is not involved with the District’s responsibility for land acquisition and construction.
There were no other comments or questions from the members of the City Council or Redevelopment Agency Board. Mayor Wilson asked if any written comments concerning this item had been received. The City Clerk stated that there were none.
Mayor Wilson opened the public hearing.
Troy Bristol, Land Conservation Associate for Save Mt. Diablo, supports the District’s proposal to establish adequate fire training facilities. He questioned the purchase price of the property in light of the current real estate market. He requested a copy of the land appraisal. Mr. Bristol asked if the acquisition of land and the construction of a fire training facility qualify as an appropriate use of Redevelopment Agency funds. He questioned the Summary Report finding that the use of Redevelopment funds will eliminate blight within the Project Area. He asked if the City has demonstrated that there are no funding mechanisms or actions that can be taken, other than the use of Redevelopment funds, to facilitate the acquisition of land and the construction of a fire training facility. He noted that the City’s General Plan update may include an expansion of the Urban Growth Boundary (UGB) to include this area. Successful expansion of the UGB will likely result in development in the area which may require mitigation. He asked if the City has considered requiring the dedication of land and funds for construction of the training facility from the land owner as mitigation for future development as part of the Development Agreement. This option is an alternative to using Redevelopment funds.
Cm. Hudson asked Mr. Bristol if he had asked these questions of the District. Mr. Bristol said that he had not. Cm. Hudson stated that the City’s obligation is $3 million to the District. He added that the Project is located in Danville and is not an area in San Ramon’s proposed UGB expansion. Mr. Bristol apologized for the error.
Mayor Wilson requested that Agreement C2007-102 be referenced in Resolution RDA 2010-005 and the City Council Resolution No. 2010-070.
Deputy Executive Director Fontes stated that the demand for this type of training facility is generated by the land use approvals for the CCSP and the City Center Project. Both developments include mixed use, higher density, and mixed uses which are adjacent to each other. The training facility will include a five story training tower to match the land use entitlements in these developments. In response to Mr. Bristol’s statements, City Manager Herb Moniz clarified that the Fire District and the City are subject to appraisals of property. If entitlements are granted, the property is appraised based on the entitlements as required by law. He stated that it has been demonstrated that the Project meets the Redevelopment Project Area Plan.
Mayor Wilson requested a motion to close the joint public hearing. Cm. Hudson’s motion to close the public hearing was seconded by Cm. Livingstone and passed 5-0.
Mayor Wilson requested action by the Redevelopment Agency. Cm. Hudson asked that his motions be in compliance with Measure J. Mbr. Hudson’s motion to adopt Resolution RDA 2010-005 was seconded by Mbr. Livingstone. Agency Chair Rowley asked the Board to vote. The motion and passed 5-0.
Mayor Wilson stated that the City Council is in session to consider Resolution No. 2010-070. Cm. Hudson’s motion to adopt Resolution No. 2010-070 was seconded by Cm. Perkins and passed 5-0.
At 6:59 p.m., there being no further business, Mayor Wilson adjourned the joint City Council and the Redevelopment Agency Board meeting.
