GEOLOGIC HAZARD ABATEMENT DISTRICT NO. 1990-01 MEETING

May 26, 2009

A regular meeting of the City of San Ramon Geologic Hazard Abatement District No. 1990-01 was held May 26, 2009 at 6:36 p.m. in the City Council Chamber at City Hall, 2222 Camino Ramon, Board Chair Wilson presiding.
PRESENT:  Board Members Livingstone, Perkins, and Rowley, Board Vice Chair Hudson, and Board Chair Wilson.
STAFF PRESENT:  City Manager Herb Moniz, Deputy City Attorney Alicia Poon, Senior Engineer Robin Bartlett, and District Clerk Patricia Edwards.

Deputy City Attorney Alicia Poon led those in attendance in the pledge of allegiance.

APPROVAL OF MINUTES

Vice Chair Hudson’s motion to approve the April 28, 2009 meeting minutes was seconded by Mbr. Rowley and passed 4-0.  Mbr. Livingstone abstained.

NEW BUSINESS

(#8.1) Public Hearing: Geologic Hazard Abatement District No. 1990-01 (GHAD) - Adopt Resolution GHAD 2009-003 – Confirming and Levying the Assessment for Geologic Hazard Abatement District No. 1990-01 for Fiscal Year 2009/10.

Robin Bartlett, Senior Engineer, provided the report and a history of Geologic Hazard Abatement District (GHAD) assessments.  The proposed budget includes no increase in the GHAD assessment rate for Fiscal Year 2009/10.  A total of 6,520 public hearing notices were mailed in compliance with the Public Resources Code requirement to annually notice property owners within the GHAD.  Three responses were received.  Two property owners requested that no new taxes be levied and that the assessment be eliminated.  One person requested a copy of the Engineer’s Report. 

Board Chair Wilson opened the public hearing.  There were no requests to address this item.  Board Chair Wilson closed the public hearing.

Vice Chair Hudson’s motion to adopt Resolution GHAD 2009-003 was seconded by Mbr. Livingstone and passed 5-0.

Mayor Wilson noted that the 2009/10 GHAD assessments will be at the same rate as last year.  Cm. Livingstone asked if any public comments were received regarding the cellular telephone leases.  Mr. Bartlett responded that there were no public inquiries regarding this item.  Verizon Wireless requested an easement or access lease to enable them to access their newly acquired cellular telephone site at an EBMUD tank location.  This lease is currently being processed.

At 6:43 p.m., there being no further business, Board Chair Wilson adjourned the meeting.
