GEOLOGIC HAZARD ABATEMENT DISTRICT NO. 1990-01 MEETING

A regular meeting of the City of San Ramon Geologic Hazard Abatement District No. 1990-01 was held May 25, 2010 at 6:30 p.m. in the City Council Chamber at City Hall, 2222 Camino Ramon, Board Chair Wilson presiding.
PRESENT:  Board Members Hudson, Livingstone, and Perkins, Board Vice Chair Rowley.
ABSENT:  Board Chair Wilson.
STAFF PRESENT:  City Manager Herb Moniz, Interim City Attorney Roger Peters, Senior Engineer Robin Bartlett, and District Clerk Patricia Edwards.

APPROVAL OF MINUTES

Mbr. Hudson’s motion to approve the April 27, 2010 meeting minutes was seconded by Mbr. Livingstone and passed 4-0.  Board Chair Wilson was absent.

NEW BUSINESS

(#8.1) Public Hearing:  Geologic Hazard Abatement District No. 1990-01 (GHAD) - Adopt Resolution GHAD 2010-002 – Confirming and Levying the Assessment for Geologic Hazard Abatement District No. 1990-01 for Fiscal Year 2010/11.

Senior Engineer Robin Bartlett provided the report.  On April 27, 2010, the Geologic Hazard Abatement District (GHAD) Board adopted the 2010/11 Engineer’s Report and a resolution of intent to order GHAD assessments.  The proposed rates for 2010/11 are $120.53 per residential unit per year and $0.0386 per square foot of nonresidential area per year.  This assessment is a 4% increase from 2009/10.  A total of 7,231 public hearing notices were mailed on May 7, 2010 in compliance with the Public Resources Code.  Five responses were received.  Two responses requested that there be no increase.  Two responses requested additional information.  One response supported the increase but wanted more information about the GHAD and its reserves.

Board Vice Chair Rowley opened the public hearing.  There was one request to address this item.

Steve Wagit, resident, questioned if the 4% increase applied to both residential and nonresidential property.  Mr. Bartlett responded that it did.

Board Vice Chair Rowley closed the public hearing.

Mbr. Perkins thanked staff for including an inflation factor on the Reserve.  He asked if an inflation factor is applied to the projected landslide repair of $1 million every ten years.  Mr. Bartlett responded that an inflation factor is applied to the overall expenses.  Mr. Bartlett stated that the basic Bay Area CPI factor was used as the inflation factor.  Mbr. Perkins asked if the 4% is the increase in the fee or the increase in revenue.  Mr. Bartlett stated that the assessment increase is 4%.  The increase in revenue is more than 4%. 

Mbr. Hudson’s motion to approve Resolution GHAD 2010-002 was seconded by Mbr. Livingstone and passed 4-0.  Board Chair Wilson was absent.

At 6:40 p.m., there being no further business, Board Vice Chair Rowley adjourned the meeting.
