GEOLOGIC HAZARD ABATEMENT DISTRICT NO. 1990-01 MEETING

May 24, 2011

A regular meeting of the City of San Ramon Geologic Hazard Abatement District No. 1990-01 was held May 24 , 2011 at 6:35 p.m. in the City Council Chamber at City Hall, 2222 Camino Ramon, Board Chair Wilson presiding.
PRESENT:  Board Members Hudson, Livingstone, Rowley, Board Vice Chair Perkins, and Board Chair Wilson.
STAFF PRESENT:  City Manager Greg Rogers, City Attorney Sheryl Schaffner, District Engineer Robin Bartlett, and District Clerk Patricia Edwards.

APPROVAL OF MINUTES

(5.1) Minutes of the April 26, 2011 meeting.

Mbr. Rowley’s motion to approve the April 26, 2011 meeting minutes was seconded by Mbr. Hudson and passed 4-0.   Board Vice Chair Perkins was absent.

CONSENT CALENDAR

(6.1) Geologic Hazard Abatement District No. 1990-01 (GHAD) – Adopt Resolution GHAD 2011-004 – Authorizing the GHAD Chair to Execute an Agreement with G.N. Henley, Inc. for Maintenance and Emergency Response Services for a Period between July 1, 2011 to June 30, 2014 in an Amount Not to Exceed $350,000.

Mbr. Hudson’s motion to approve Resolutions GHAD 2011-004 and GHAD 2011-005 was seconded by Mbr. Livingstone and passed 4-0. Board Vice Chair Perkins was absent.

(8.1) Public Hearing:  Geologic Hazard Abatement District No. 1990-01 (GHAD) - Adopt Resolution GHAD 2011-006 – Confirming and Levying the Assessment for Geologic Hazard Abatement District No. 1990-01 for Fiscal Year 2011/12.

District Engineer Robin Bartlett provided the report.  On April 26, 2011, the Geologic Hazard Abatement District (GHAD) Board approved the Fiscal Year 2011/12 Engineer’s Report and Updated Reserve Fund Study.  The Board adopted Resolution GHAD 2011-002, a resolution of intent to order assessments for FY 2011/12 for Geologic Hazard Abatement District No. 1990-01 and set a public hearing for May 24, 2011.  The proposed new rates for FY 2011/12 are $125.35 per residential unit and $0.04 per square foot of non-residential area.  Since the proposed FY 2011/12 assessment falls within the assessment limits of $250 per residential unit and $0.10 per square foot of nonresidential property, a mailed ballot election process was not required.  A total of 7,227 public hearing notices were mailed on May 4, 2011 in compliance with the Public Resources Code.  Twelve responses were received.  There were eight requests for general information.  Four property owners opposed the assessment.  Mbr. Livingstone asked if the increase of four percent, which is approximately $5.00 per property, is larger than last year’s increase.  Mr. Bartlett stated that it is not.

Chair Wilson opened the public hearing.  There were no requests to address this item. 

The District Clerk stated that two emails were received.  Frank Meehan stated his objection to the increase.  Mr. Gary Nickles also stated his objection to the assessment increase and requested no new rate hikes or fees.  

Chair Wilson closed the public hearing.  

Mr. Bartlett stated that the assessment increase is intended to build an endowment which would be large enough to self fund the GHAD.  By systematically increasing the assessment fee until the ceiling is reached, the GHAD will meet its target reserve.  The GHAD Reserve Fund Study was completed in 2003.  The study recommends that the GHAD accumulate a reserve fund of $8 million (2003 dollars) in order to provide for large significant events as well as maintenance and monitoring function.  In order to meet this goal, it is recommended that a 4% increase per residential unit be assessed for Fiscal Year 2011/12.  Cm. Hudson stated that it is better to increase in small increments each year to achieve this goal.

Mbr. Hudson’s motion to approve Resolution GHAD 2011-006 was seconded by Mbr. Livingstone and passed 5-0.
