MINUTES OF THE
August 6, 2013
A regular meeting of the Planning Commission for the City of San Ramon was called to order by Vice Chair Benedetti at 7:00 p.m., on Tuesday, August 6, 2013 in the Council Chambers 2222 Camino Ramon, San Ramon.

9. PUBLIC HEARING – NEW ITEMS
Shinei Tsukamoto, Associate Planner gave a summary stating that the applicant is requesting approval of a Land Use Permit application to allow for a “Day Care Center” e for use as a “Heritage School.” The Day Care is a commercial facility to accommodate up to 15 children or more. The proposed hours of the operation would be between 9:00 a.m. and 6:00 p.m. Monday through Friday.Commissioner Kerger asked about the background of the school and was there going to be an outside play area.
Mr. Tsukamoto replied the Heritage School current facility was established at the Court yard. Recently the San Ramon Valley Fire District inspected the Courtyard facility, and found it not up to code. The landlord was unable to work with the applicant and the applicant chose to move to a different location. Mr. Tsukamoto added that the outdoor play area is not required because it is not classified as Day Care facility by the State.
Commissioner Sachs commented that the outdoor play area was not needed because the programs are all indoor related. Commissioner Sachs asked for clarification on Conditions of Approval #14.
Mr. Tsukamoto replied plans that are submitted need to comply with the City’s Security Ordinance contained within the Municipal Code. Based on the conversation staff had with the applicant they will be installing security cameras in each room that is being utilized.
Vice Chair Benedetti asked if the applicant previous operation required a Minor Use Permit (MUP) and an outside play area. Mr. Tsukamoto replied yes it did require a minor use permit and that an outside play area was not required.Carol Ma – Applicant stated that school had originally started in Cupertino only for preforming arts. Ms. Ma stated the activities include classes for adults, children that are taught Chinese language art and dance.
Commissioner Kerger asked is Ms. Ma if she was looking to expand her business. Ms. Ma yes.Douglas Chang –stated that Ms. Ma is very dedicated to her students and enjoys cultural studies. Mr. Chung added that only 2-3 students typically attend the morning class. There would be no traffic impact.
Commissioner Viers stated that there is a need for this type of use in the community and is in favor of the project.
Commissioner Kerger stated that she is pleased with the project.
Vice Chair Benedetti asked Division Manager Debbie Chamberlain if a condition could be added that the plans would need to be routed to the Police Department for review. Ms. Chamberlain replied yes. Vice Chair Benedetti added that she is pleased with the project and that safety concerns were addressed and an outside play area is not needed.
It was moved by Planning Commissioner Sahcs and seconded by Planning Commissioner Viers that the Planning Commission accepts Resolution number 07-13 approving a Land Use Permit (LUP 12-500-004) regarding the Fantasia Chinese Heritage School were the Planning Commission accept the resolution and the conditions of approval amended by staff.
